TERMS AND CONDITIONS
Terms and Conditions (“Terms”) of a limited period Booster Water (“Offer”) of BOOSTER WATER PVT LTD (“Company”) for the consumers in general trade are as follows:
A. PROGAM DETAILS, CONCEPT AND PARTICIPATION
i. These terms and conditions shall apply to the “Lucky Draw Scheme” (herein after referred to as the "Program") sponsored by BOOSTER WATER PVT LTD (herein after referred to as the "Booster Water") wherein consumer can participate, voluntarily, by their own free choice by buying Booster Water’s from its website www.boosterwater.com between 15th January 2024 to 31st March’ 2024 (both dates are inclusive).
ii. This Offer is operational Pan India, on the purchase of the “Booster Water’s” products from company’s website and shall be valid from 1st January 2024 to 31st March 2024 (both days included) (“Offer Period”).
iii. The Program is subject to all applicable central and state laws and regulations of India. iv. The winner will be selected via a random draw from all eligible entries received during the promotion period. Booster Water shall not be held liable to explain the process by which the winner has been chosen.
B. PROCESS AND CRITERIA FOR PARTICIPATION IN A LUCKY DRAW:
i. To enter the lucky draw contest, participants must make a minimum purchase of INR 2500 on the www.boosterwater.com website.
ii. During checkout, participants must enter the promotional code "TRI400" to be eligible for entry into the contest.
iii. Multiple entries are permitted, provided that each entry is associated with a separate qualifying purchase
iv. A successful order is defined as any order with net value higher than or equal to Rs 2500, post any cancellation or returns, after applying any discounts, coupon codes, etc.
v. In case of any cancellation or returns, where order does not meet the criteria for a successful order, you will not be eligible for the offer.
vi. The directors, employees, dealers, distributors, agents, vendors, representatives, business associates of the Company and/or the Agency and/or their family members and/or anyone else connected in any manner with this Offer, shall not be eligible to participate in the Lucky Draw.
vii. The participation in Lucky Draw will be valid for multiple purchase invoices and voucher codes received by the same consumer during Offer Period provided each order amount is more than Rs. 2,500/-.
viii. The winners of Lucky Draw will have to bear all accessories, taxes, transportation and/ or incidental costs (if any) that may be applicable to the Prize.
ix) The Company/ Agency will not be responsible for downtime on the prize product and related services, caused due to technicalities (like failure of equipment, configuration issue, network congestion), or due to decisions/ changes in regulations that are carried out by any statutory/ regulatory authority.
C. AGREEMENT TO TERMS AND CONDITIONS:
i. By participating in this program, participants fully and unconditionally agree to accept and abide by these Terms and Conditions available and given on https://boosterwater.com/ ("Program Website") as well as the decisions of Booster Water, which shall be final and binding in all matters related to the Program. Successfully entering the Program and winning a prize is subject to complying all requirements set forth herein.
ii. Booster Water reserves the right to exclude any person from the program at any time on the grounds of him being the subject of criminal investigation or due to misconduct or criminal record or conviction of any crime.
iii. The Gift/ Prize offered are subject to stock availability and the Company reserves the right to substitute the Gift/ Prize under this Offer with an alternate gift/ prize of equivalent value at its own discretion.
D. ELIGIBILITY:
i. This Program is applicable only for the individual purchase of Booster Water’s bottles/can (see product eligibility below) by end-user (consumer) across India. This scheme is not applicable for the institutional, organizational or corporate purchases.
ii. Participation by people below 18 years of age shall not be allowed.
iii. In order to be eligible for the prizes, the participant must have a valid photo ID Proof, Address Proof, PAN Card/ AADHAR CARD, and the original Invoice. In case of non-availability of the PAN card/ AADHAR CARD, winner won't be able to claim the prize.
iv. Booster Water or its partner agency for the program shall not be responsible for any NDNC (National Do Not Call) Registry regulation that comes into play. All participants who participate hereby agree and give express consent to Booster Water and its partner agency for the program that even if they are registered under NDNC, DND (Do Not Disturb), Booster Water or its partner agency for the program, will have the valid authority to call such shortlisted participants, by virtue of them having voluntarily participated in the program.
v. People participating or seeking to participate in the Program shall individually be referred to as "Participant" and collectively as "Participants".
E. PROGRAM PERIOD AND ELIGIBLE PRODUCTS:
i. The program will commence on 15th January 2024 to 31st March 2024 (both dates inclusive) and shall be referred as the “Program Period”.
ii. This program shall run across all the BOOSTER WATER’S products, excluding the Booster Natural Mineral water packs.
iii. The Participants can make an entry at any time during the Program Period i.e. choose the day when he/she wishes to participate during the Program Period. The date of purchase of the product should fall between the program duration only.
iv. The Scheme (Lucky Draw) will be introduced from 15th January 2024 to 31st March 2024. v. Booster water reserves the right to further extend the promotion end date without any explanation.
F. WINNER SELECTION:
i. The winner will be selected via a random draw from all eligible entries received during the promotion period.
ii. The draw will take place within [30] thirty days of the promotion period ending.
iii. The winner will be notified via email within seven days of the draw date.
iv. If the winner does not respond within 14 days of notification, a new winner will be selected via a second draw.
v. In the event that the winner does not take the prize, in the time and manner stipulated, then the prize shall be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. The right to claim the prize cannot be transferred by the participant to any other person. No cash alternatives or alternative prizes are available.
vi. The images of the prizes depicted on the press ads/posters/Triump 400 vehicle/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made. All images used to depict prizes are proprietary to the respective Brand/manufacturer.
vii. Booster Water, its directors, officers and employees and those of its affiliates, indemnified and harmless from and against any and all losses, damages, expenses, fees (including legal fees and costs), liabilities whether civil or criminal, arising due to any loss/ compensation, whatsoever, occurred to the consumer.
viii. All taxes, levies and charges on the prize will be borne by the winner.
ix. Any participant of the program who wins any prize during the Program Period shall not be eligible to win any further prizes.
x. The benefit under this Offer is non‐transferrable, non‐refundable and no physical cash payment will be made in lieu thereof.
G. CONTACTING WINNERS:
i. Once the Participants are shortlisted, the Partner Agency appointed by Booster Water shall dispatch the prizes to the respective dealers from whom the Booster Water Bottles was purchased.
ii. Lucky Winner will get one unit of Triumph 400S Bike.
iii. The vehicle delivery will be at the Triumph 400 showroom located in Hyderabad city or any other City where the vehicle is available for sale.
iv. The company doesn’t guarantee the delivery period of the vehicle at the completely depends on the vehicle distributors and company selling the vehicle.
v. Winner will be required to collect their gift from the Company by submitting a copy of the following documents:
1. The original invoice of Booster water purchased AND 2. Self-attested copy of any two Photo Identity proof (e.g. Valid Driver's license, Voter's Identity card, Valid Indian Passport, Permanent Account Number (PAN) card or Aadhar card).
H. Tax Certificate as applicable.
a) In case a participant not contacted, it shall automatically mean that the person's name has not come through the selection process and he/she is not a winner.
I. PUBLICITY:
i. By accepting the prize(s), the Winner undertake and irrevocably and unconditionally permit BOOSTER WATER to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, public events etc., and the Winner shall not raise any objection, protest or demur to such coverage or in this regard.
ii. The Winner hereby grants to BOOSTER WATER, the right to use their photograph(s), sound-bites, write-ups, video in any media found suitable.
J. INTELLECTUAL PROPERTY:
i. All right, title and interest, including but not limited to the Intellectual Property Rights, in the Promotional material(s) and in any and all responses received shall vest solely and exclusively with Booster Water at all times.
ii. All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Booster Water upon submission and become the property of Booster Water exclusively. Booster Water may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of BOOSTER WATER.
K. DISPUTE:
i. The rights and obligations of the Participants and/or BOOSTER WATER and/or Partners of this Program, shall be governed and construed in accordance with the laws of India and the courts of competent jurisdiction at Pune shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Program.
ii. In the event, the Offer is termed as void due to introduction of any new legislation or by amendment to the existing legislation or by judicial orders, the Company shall not be liable to award any Gift/ Prize or any compensation in lieu thereof to the customers/winners.
L. Force Majeure
i. BOOSTER WATER or its Partner Agency shall not be liable for any failure or delay to fulfil any of our obligations hereunder, to the extent the same is caused by force majeure events such as floods, earthquakes, fire, riots, civil unrest, war (declared or not), strikes and lock-outs, or any other circumstances beyond the reasonable control of Booster Water or its Partner Agency and shall not be liable to compensate the participant in these circumstances. Booster Water shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Program due to any government restrictions.
M. WARRANTIES/PRODUCT RELATED QUERIES:
i. The prizes will be governed by the normal terms of warranties and/ or guarantees, of the manufacturer of the prizes and Booster Water or its Partner Agency shall not be held liable or responsible for the same. The Prize winner shall contact the manufacturer service center directly for any issue, whatsoever, related with the Prize.
ii. Any queries/ doubts/information related to the functioning of the prizes (assured prize/monthly regular prize) shall be directly directed to the manufacturer/distributor of the prizes that shall be solely liable and responsible for any/all queries related to it.
N. MISCELLANEOUS:
i. Mere participation in this Program does not entitle a participant to a prize unless all other terms and conditions are fully complied with. Any fraudulent conduct on the part of the participant shall disentitle the participant to receive the prize under this Program.
ii. Booster Water reserves the right to change, defer, alter or cancel this Program in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Booster Water in this regard and in general with respect to this Program and the terms and conditions thereto shall be final and binding.
iii. The decision of Booster Water shall be final in all regards and no communication, queries or complaints shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any participant and Booster Water and the participant shall not have the authority to bind Booster Water in any manner whatsoever.
iv. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of BOOSTER WATER PRIVATE LIMITED or its Partner Agency.
v. If a participant is dissatisfied with the Program and/or the terms and conditions of the Program, his/her sole and exclusive remedy is to not to participate in the Program.
Participating in this Promotion is deemed acceptance of the above Terms and Conditions.
